New York Fracking Ban Bill Vetoed; SGEIS Deadline Extended

Outgoing New York Gov. David Paterson took the high road on Saturday, vetoing a bill that would have codified into law a moratorium on hydraulic fracturing (fracking) in the state through May 15, and at the same time extending until July 1 a deadline for the state’s Department of Environmental Conservation (DEC) to prepare a supplemental generic environmental impact statement (SGEIS).

Southern said Friday its market-area forecast called for warmer temperatures Saturday “and then turning dramatically colder for Sunday and even colder into [this] week.” It was extremely likely that storage withdrawal requirements would exceed system capability coming out of the weekend, Southern said, so an OFO Type 6 for short imbalances will take effect Monday until further notice. Tiered penalties will apply to negative daily imbalances exceeding 2% or 200 Dth, whichever is greater. Southern added that it will not be accepting nominations for due-shipper imbalance makeups and will evaluate on each scheduling cycle nominations for interruptible services that rely on storage withdrawals.

Citing limited operational flexibility and mild weather, Tennessee said a systemwide OFO Action Alert will take effect Saturday for all Balancing Parties. Penalties will apply to all such parties who exceed a positive daily imbalance tolerance of 2% of scheduled quantities or 500 Dth, whichever is greater. “In the event the OFO Action Alert is not sufficient to maintain the operational integrity of the system, Tennessee may issue a Critical Day or an OFO Balancing Alert,” the pipeline said.
