Andersen’s Sentence, Fine Harshest Allowed Under Law

U.S. District Judge Melinda Harmon handed Arthur Andersen LLP the maximum sentence in Houston on Wednesday — five years probation and a $500,000 fine — for obstructing justice in its handling of Enron Corp.-related documents that stymied a federal investigation of the company’s finances. Although it seemed minuscule when compared to the substantial market damage caused by the Enron scandal, the punishment was the harshest allowed under law. Andersen attorneys said they would appeal.

Northeast, FL Citygate Spikes Stand Out Amid Flatness

Although this week’s winter siege likely was reaching its maximum area of penetration Wednesday, for the most part it had lost much of its price-boosting power. Except for big advances by Florida citygates and some citygates in the Northeast, the rest of the cash market had settled down for a generally flat performance, with scattered points showing 1 to 5 cent increases.

Saying it was experiencing maximum withdrawals at the Washington Ranch storage facility, El Paso declared an Unauthorized Overpull Penalty situation Wednesday morning due to low linepack. Because of the OFO and high system demand, a maintenance shutdown of Line 1100 upstream of Guadalupe Station that had been scheduled for today was postponed until further notice.

El Paso Natural Gas has filed an application at FERC to increase the existing maximum daily export capacity on the Samalayuca Lateral by about one-third to 308 MMcf/d to meet the growing natural gas demand in northern Mexico, which is being fueled in large part by power generation.

FERC Orders Interconnections for Third-Party QF Sales

Looking to ensure that the maximum amount of qualifying facility (QF) power is available to the California energy market this summer, FERC last week ruled that when QFs in the state sell excess power or make sales to third parties under court authorization, they should be allowed to request interconnection and transmission service from utilities in California. The Commission proposed ordering California utilities to provide interconnections to state QFs under a key section of the Federal Power Act.
