The effort to put a natural gas severance tax hike before Arkansas voters has been suspended as backers came up short on the number of signatures necessary to put the issue on the November ballot (see Shale Daily, July 10; June 29). Tax hike proponent Sheffield Nelson told local news media he would make a final decision on whether to abandon the effort within a week. The campaign is short about 40,000 signatures after many were disqualifed. The campaign would need to make up the shortfall by Aug. 20 and deliver at least 62,507 valid signatures in total.

FERC’s 15-year-old approval of a developer’s proposal to construct a liquefied natural gas (LNG) liquefaction and export facility in Alaska is outdated and no longer valid, the Commission said. However, the project could be reauthorized if additional information is provided.

Investigators Scrutinizing Stock Sales by Lay in Months before Enron’s Fall

With former Enron Corp. executive Michael Kopper’s guilty plea last month, sources indicate that federal investigators are now closer to indicting former CFO Andrew Fastow, and plan to also target former CEO Jeffrey Skilling. And former Chairman Kenneth Lay? Though he has yet to receive the notoriety of his former financial whiz kids, investigators in Houston and Washington, DC apparently have been quietly scrutinizing Lay’s stock sales in the months and years before the Houston company filed for bankruptcy — at least for now.

Arbitration Holds LG&E to Power Contract

A three-member arbitration panel ruled that Oglethorpe PowerCorp.’s power marketing contract with LG&E Energy Corp. andLG&E Energy Marketing Inc. is valid and must be honored.LG&E began its challenge to the contract in 1998. The companysaid the decision will cause it to increase its fourth quarterafter-tax accrued loss on disposal of discontinued operations by$175 million. The loss stems from increased load demands, higherthan anticipated future commodity prices and other factors. Theincrease in the loss reserve will be recorded in discontinuedoperations.
