West Virginia Court Clarifies ‘Surface’ Definition

West Virginia’s legal system continues to struggle with surface rights issues, with the state’s Supreme Court of Appeals finding recently that the term “surface” means just what it says and does not include underground resources.

Abraxas Petroleum Corp. has completed its first Eagle Ford Shale well in South Texas. Blue Eagle Energy LLC, a joint venture of Abraxas formed with Rock Oil Co. (formerly Blue Stone Oil & Gas LLC) last year (see Daily GPI, Aug. 30, 2010), drilled the T Bird 1H well in DeWitt County, TX, to a total depth of 19,450 feet, including a 5,700-foot lateral. The well was completed with a 15-stage fracture stimulation and recently placed online at a restricted rate approximately 75 days after spudding, according to San Antonio-based Abraxas. The well is being opened slowly to prevent formation damage and an unrestricted rate will be announced in the near future.

The domestic oil and natural gas resource base in restricted and unrestricted onshore and offshore areas will grow by more than what the Energy Information Administration (EIA) has projected over the next two decades, according to a new study commissioned by the National Association of Regulatory Utility Commissioners (NARUC).

Talisman Hits Pay Dirt in Alberta Foothills

Talisman Energy Inc. said it hit pay dirt again in the Alberta Foothills. A new well tested at a gross rate of 14 MMcf/d but if left unrestricted by surface equipment would have had an estimated absolute open flow rate potential of 372 MMcf/d and estimated wellhead absolute open flow rate potential of 94 MMcf/d. The well is expected to be tied-in during the second quarter of 2007.

FL Utility Offers Unrestricted Non-Residential Choice

Breaking new ground in Florida’s gas industry, City Gas Co., anNUI Corp. utility subsidiary, announced last week that a newlypassed tariff has enabled third-party suppliers in its serviceterritory to sign commercial and industrial customers withoutrestriction. The new program, called the Commercial TransportationService, is the first choice program without limitations in thestate, City Gas said. The plan was approved in late November by theFlorida Public Service Commission (PSC).
