CA Regulators Tire of Emergency Requests

Showing some tiredness with the continuing round of “emergency”declarations swirling throughout California’s energy markets, stateregulators Thursday refused to consider an eleventh-hour request bySouthern California Edison Co. to modify a legislatively-setpricing formula for renewable energy and qualifying facilities (QF)from which it buys power in lieu of the current unprecedentednatural gas prices. The payment formula is based on price indicesfor gas at the California-Arizona border, which saw spot prices atthe $36 to $41/Mcf level earlier this week.

Power Shock Sends CA Players Running for Risk Management

In the wake of California’s latest round of electricity priceand supply shock concentrated in San Diego, some of the state’smajor energy industry participants have raised the level ofinterest in forward markets and hedging. San Diego Gas and ElectricCo., in particular, has been second guessed about why it did notuse available hedging instruments through the state’s nonprofitpower exchange to help ease the impact of recent wholesale pricespikes on its retail customers.

Late Futures Buying Gives Bulls Five-Game Sweep Last Week

Retracing an early round of profit-taking, natural gas futuresclawed their way higher Friday as traders put the finishing toucheson a week in which prices not only notched a new life-of-contracthigh at $3.385, but also posted a fresh prompt contract 30-monthhigh. With Friday’s 0.2-cent increase, the June contract advancedeach day to gain 32.9 cents for the week. June finished at $3.354amid light estimated volume of just 54,639.

NiSource Inc. has lost another round in its takeover bid forColumbia Energy. A Delaware court judge earlier this week dismissed aNiSource lawsuit aimed at forcing Columbia to reconvene its annualstockholders’ meeting in order to elect a 13th member to the board ofdirectors. NiSource claimed Columbia acted illegally in not fillingthe vacancy at its last annual meeting. NiSource was seeking to electits own representative for Columbia’s board as part of its campaign toannex the Herndon, VA, company through a $68/share hostile takeover. ADelaware Court of Chancery judge said Wednesday he did not believethere was a legal or practical basis for restaging the annualmeeting. NiSource, which made the takeover bid in early June, has twoother lawsuits targeting Columbia still to be decided (See Daily GPI,July 30).

Late Rebound Puts Bulls Back at Helm

Despite a round of midday profit taking, the natural gas futuresmarket was able to eke out a modest advance amid continued see-sawtrading activity yesterday. The September contract led all othermonths, posting a 1.9-cent gain en route to a $2.727 close.Estimated volume was robust with 86,261 contracts changing hands.

Richard, Neale Duking it Out

Midway through round four of the NiSource-Columbia bout last week there still was no clear leader as CEOs for both companies went back to gnawing at each other’s ears. It’s been four weeks since NiSource Chairman Gary Neale threw the first punch with a $5.7 billion, $68/share offer for Columbia Energy Group’s outstanding shares, and it’s now two weeks before that offer expires.
