CA Attorney General Sues Sempra Energy Trading

With an apparent stalemate in settlement negotiations, the California Attorney General Bill Lockyer will file a lawsuit against Sempra Energy’s trading unit alleging “Enron-like” wholesale energy market manipulation tactics during the western energy crisis four years.

Illinois Retail Gas Marketer Santanna Files for Ch. 11, Sued by Attorney General

Escalating natural gas prices forced Illinois retail gas marketer Santanna Energy to file for Chapter 11 bankruptcy protection on Monday just a few days after Illinois Attorney General Lisa Madigan filed a lawsuit in Cook County Circuit Court against the company because it reneged on its fixed-rate contract offerings to about 15,000 northern Illinois residential customers.

Atlantic-based IntercontinentalExchange (ICE) has announced plans to conduct an initial public offering of its common stock. It plans to file a registration statement with Securities and Exchange Commission in the next several weeks. ICE operates an online exchange for trading natural gas, crude oil and power futures and over-the-counter energy products. ICE conducts its markets for futures trading through its subsidiary, London-based International Petroleum Exchange (IPE), Europe’s leading energy futures and options exchange. ICE also announced its 2004 financial results on Wednesday, reporting revenues of $108.4 million and consolidated net income of $22 million. Consolidated cash flow from operations was $40.3 million. Capital expenditures and capitalized software in 2004 totaled $6.5 million. For 2004, volume traded on ICE’s futures subsidiary, the International Petroleum Exchange (IPE), reached 35.5 million contracts. Electronically traded IPE Brent volume increased from 2.8% of total contract volume in January 2004 to 27.2% of total contract volume in December 2004. Mackenzie Gas Project Co-Sponsors to File Regulatory Applications

The Mackenzie Gas Project co-sponsors, led by Imperial Oil Resources, said Thursday that the main regulatory applications will be submitted to the boards, panels and agencies responsible for assessing and regulating energy developments in the Northwest Territories this week. However, Imperial noted in a statement that a final “decision to construct the project has not been made.”

Dynegy to Restate 2003 10-K, 2004 Statements to Reflect Utility Sale

Dynegy Inc. said Wednesday it will re-file 2003 Form 10-K and 1Q2004 and 2Q2004 financial statements related to goodwill impairment charges associated with the pending sale of Illinois Power (IP). The adjustments are not expected to impede the sale, nor does Dynegy expect the refilings to impact current cash and liquidity positions or its 2004 earnings guidance estimate of 3-8 cents/share.

Western Utilities, Attorneys General Seek FERC Ruling on Enron Termination Payments

FERC should clarify a recent order in which it ordered Enron to forfeit $32.5 million in unjust profits by confirming that it didn’t intend to exclude from the scope of the proceeding Enron contracts that were executed from Jan. 16, 1997 to June 25, 2003 and under which Enron “continues to demand, but has not yet collected, unjust profits in the form of termination payments,” a collection of western-based electric utilities, state attorney generals and utility regulators said on Wednesday.
