Marketers Ordered to Pay $12M for Illegal Open Season Conduct

FERC Thursday approved four stipulation and consent agreements, requiring marketers and other energy firms to pay more than $8 million in civil penalties and disgorge approximately $4 million in unjust profits for allegedly engaging in fraudulent open-season bidding for natural gas transportation capacity on the Cheyenne Plains Natural Gas Co. pipeline. The agency also issued two orders to show cause resulting from an 18-month investigation into the illegal activity.

ICE’s $1B Merger with NYBOT a Done Deal

Electronic energy marketplace IntercontinentalExchange (ICE) said late Friday it has consummated its $1 billion-plus merger with the New York Board of Trade (NYBOT), the 100-year-old open outcry exchange for sugar, coffee, cocoa, cotton and other commodities and financial products. The transaction consideration comprised 10.297 million shares of ICE common stock and $400 million in cash.

Combined WPS-Peoples Will Focus Mainly on Regulated Businesses

Assuming it’s consummated, the acquisition of Peoples Energy Corp. by WPS Resources Corp. will result in a Chicago-based utility holding company with a Green Bay, WI-based nonregulated energy marketing operation. The company will have regulated utilities in four midwestern states. Nonregulated businesses will serve customers in the Northeast and Canada.

Thefacilities represent up to $800 million in local investment. Allfour plants are expected to be in service in time for peak summerdemand in 2002.
