Western Governors Seek Removal of NEPA Review Exemption for Drilling

FERC Extends Record Retention for Market-Based Rate Transactions

A draft order released Thursday by FERC would amend Commission regulations to extend to five years from three the records retention requirement applicable to all transactions that fall under FERC’s market-based rate authorizations for power and natural gas. The decision completes the Commission’s recent modifications to its energy market behavior rules.

Shareholders Amend Lawsuit Against Dynegy

A shareholder lawsuit originally filed last year against Dynegy Inc. was amended on Friday to include more plaintiffs in a complaint that alleges the company hid an $850 million loan from Citicorp through an off-balance sheet transaction in 2000 to preserve its credit rating. The lawsuit is led by the University of California, which has lost millions on its Dynegy investments.

CCRO Urges Transaction Reporting to Price Surveys

The Committee of Chief Risk Officers (CCRO), pointing to gaps in gas price reporting during the March bidweek, has urged energy buyers and sellers to continue to submit data on transactions to “index developers” during the transition time until its complex and detailed new rules can be put in place. At the same time, another group, the Process Gas Consumers (PGC) representing end users whose processes require the use of natural gas, has advised FERC Chairman Pat Wood it is “strongly” opposed to the federal government taking a hand in the price reporting process for natural gas.
