The U.S. Supreme Court on Thursday overruled a lower court to uphold key federal authorizations issued to Mountain Valley Pipeline LLC (MVP), a major legal victory for the project as it seeks to complete construction this year.

A brief order handed down by the nation’s highest court Thursday vacated stays issued earlier this month by the U.S. Court of Appeals for the Fourth Circuit. In response, MVP submitted an emergency filing asking the Supreme Court to overrule the lower court’s actions.

The Fourth Circuit had stayed the natural gas conduit’s Endangered Species Act permitting and its approvals for construction through the Jefferson National Forest. The stays appeared to contradict language in the Fiscal Responsibility Act (FRA) signed by President Biden in June.
