Seeking to swiftly overturn an appeals court ruling that imperils its plans to enter service by the end of 2023, Mountain Valley Pipeline LLC (MVP) has submitted an emergency filing with the U.S. Supreme Court.

The filing asks the high court to intervene and toss out a pair of stays issued last week by the U.S. Court of Appeals for the Fourth Circuit. The order by the circuit court invalidated, for now, federal authorizations required to restart construction of the 303-mile, 2 million Dth/d natural gas pipeline. The operator submitted notice to FERC late Friday of its emergency application to the Supreme Court.
