Merger Moratorium Sought by Munis

A group representing municipal- and government-owned utilitieslast week renewed its call for FERC to impose a moratorium onelectric utility mergers that threaten competition while theindustry is undergoing transition. At a minimum, it proposed thatthe Commission only approve mergers that could show “clearbenefits” that would result from such combinations.

Shippers Tentatively Support Natural Auction Procedures

Producers and marketers this week offered their conditionalsupport for a comprehensive settlement package that calls forNatural Gas Pipeline Company of America (NGPL) to implement a moretransparent auction process on its system. Several said theirsupport hinged on the outcome of five contested issues that havebeen reserved for FERC comment and resolution.

Voyageur Sponsors Seek Clean Slate

In a change of strategy earlier this week, TransCanada PipeLinesLtd. and Nicor Inc. notified FERC that they were withdrawing theirapplication for their original Viking Voyageur pipeline project toclear the path for a new application on a scaled-down version ofthe project that they intend to file early this fall.

Columbia Gas Wins Bid for New Service

Columbia Gas of Pennsylvania last week beat out Equitable Gas inthe bidding to provide service to new commercial and residentialbuildings that are slated to be constructed on a former LTV steelsite on the city of Pittsburgh’s South Side. The site, which isowned by the city’s Urban Redevelopment Authority (URA), currentlyis in the midst of major redevelopment.

Nicor Seeks to Widen Pilot to Include Residential Users

Nicor Gas earlier this week submitted a proposal to the IllinoisCommerce Commission (ICC) that, if approved, would provide customerchoice for the first time to single-family residential natural gascustomers in the northern part of the state.

Tesoro Boosts Gas Reserves with Purchase

Tesoro E&P Company L.P., a wholly-owned affiliate of TesoroPetroleum Corp., announced earlier this week it purchased a 50%working interest from Sheridan Energy in the Stiles Ranch Fieldnorth of Amarillo, TX.

CA. Regulators Toward Gas Unbundling

California regulators took another step toward unbundling thenatural gas business in the state last week, issuing proposedguidelines and saying it will remove limits on the state’sseven-year core aggregation program, meaning any size core customereventually will be able to choose a new supplier.

CPUC Allows Affiliate Employees Free Range

California regulators last week liberalized the use of utilityemployees in non-utility energy affiliate companies as part oftheir action finalizing a set of rules on the interaction betweenthe state’s three major electricity utilities and their affiliatedcompanies. With the advent of retail electric competition each ofthe utilities have several unregulated affiliates offering energysupplies and related services.

FERC Wins the Praise of Pipeline for ROR Revisions

FERC made three small but significant changes to its pipelinerate of return policy this week, winning the praise of theInterstate Natural Gas Association of America (INGAA), whichrepresents the pipelines. INGAA President Jerald V. Halvorsen saidthe Commission’s action “should help pipelines compete in theincreasingly competitive financial markets for the capital to buildprojects that are necessary to meet projections of a 30 Tcf naturalgas economy by 2010.”

FERC Sees Merit to Phelps Dodge Complaint

FERC last week came down on the side of Phelps Dodge Corp. in acomplex contract dispute with El Paso Natural Gas. It ordered theTexas-based pipeline to either add the delivery points sought byPhelps Dodge, or to show cause within a month why – due tooperational and capacity constraints – it cannot do so.
