IRS Okays Nymex Demutualization Plan

Nymex got final approval for its demutualization plan from theInternal Revenue Service, which said there would be no taxconsequences for the organization or its members. The plan, whichcalls for the equity in the exchange to remain with the seat-ownersof its Nymex Division, will make the exchange the first in New Yorkto convert from a not-for-profit membership structure to afor-profit organization.

PA PUC Okays Columbia Restructuring

The Pennsylvania Public Utility Commission approved Columbia Gasof Pennsylvania’s restructuring settlement, making the company thefirst to gain commission approval under the guidelines set forththis summer in the Natural Gas Choice and Competition Act. Thesettlement, which included 26 parties, allows Columbia to advanceits choice program, expand its customer assistance program (CAP)statewide, and provide telephonic and Internet enrollment.

Texas’ Senate Okays Electric Deregulation Bill

Senate Bill 7, legislation requiring electricity marketcompetition in Texas as of Jan. 1, 2002, passed the state SenateFriday, leaving the Governor’s signature as the missing piece ofthe puzzle before the bill becomes law. Governor George W. Bush hasnot said when he will sign the Sen. David Sibley (R-Waco)-sponsoredbill, but has voiced his support.

BGE Okays Launch of Constellation Energy

BGE shareholders approved the formation of holding companyConstellation Energy Group Inc. Constellation Energy is now set tobe launched May 3, trading under the CEG ticker symbol on the NewYork Stock Exchange. Constellation Energy will be the parentcompany that holds BGE’s common stock and the common stock of allof BGE’s current subsidiaries. BGE will become a sibling to itscurrent subsidiaries and will remain regulated by the MarylandPublic Service Commission.
