Allegheny Energy to Appeal Merrill Lynch Case

Confirming his summary judgement made in April of this year (see Daily GPI, April 14), U.S. District Judge Harold Baer Jr. on Monday found against Allegheny Energy Inc. on its breach of contract and fraudulent inducement claims against Merrill Lynch & Co. Inc. over Allegheny’s purchase of Merrill’s Global Energy Markets (GEM) trading business in 2001.

Enron Seeks Additional Six Months to Review Tapes in Manipulation Case

Enron recently asked a FERC administrative law judge (ALJ) to give the bankrupt former energy trading giant an additional six months to review thousands of hours of Enron trader tapes as part of a FERC probe into possible manipulation of California’s energy markets in 2000-2001 and Enron’s relationships and practices in the West during that time frame [EL03-180-000].

CA Thinks Enron Owes More Than $1.67B FERC Staff Seeks

The number was still hot off first press reports of FERC staff testimony before a regulatory judge when the California Attorney General’s Office called for more than the $1.67 billion federal regulatory analysts have calculated is owed by Enron Corp. for its alleged wholesale energy market manipulation during the 2000-2001 western energy crisis. California’s AG thinks it should be $2.8 billion, a spokesperson told western news media.

(SoCalGas) manipulated its incentive gas-buying program and abused its market power to drive up gas prices and increase price volatility at the Southern California-Arizona border in 2000 and 2001.

NorthWestern to Emerge in November from Bankruptcy

A federal bankruptcy court judge last week confirmed a second amended reorganization plan for South Dakota-based NorthWestern Corp., and the energy holding company said Nov. 1 would be the likely date for emerging from Chapter 11 bankruptcy proceedings. Standard & Poor’s Ratings Services raised NorthWestern’s credit rating to “BB-” from “D,” effective with the reorganization plan’s start.

FERC ALJ Certifies Settlement Lowering Rates on Eastchester Extension

A FERC administrative law judge (ALJ) on Thursday certified an uncontested offer of settlement that reduces by about 20-25% the transportation rates for shippers on Iroquois Gas Transmission System’s Eastchester extension that went into service earlier this year.
