ALJ Rules Former Amaranth Trader Manipulated Gas Markets

A FERC administrative law judge (ALJ) has issued an initial decision finding that former Amaranth natural gas trader Brian Hunter manipulated the gas futures market between February and April 2006, which subsequently took a toll on physical gas contracts over which the Federal Energy Regulatory Commission (FERC) has jurisdiction.

AES Sparrows Point Mulls Rehearing of Fourth Circuit Ruling

In the wake of a recent decision by a three-judge panel of the U.S. Court of Appeals for the Fourth Circuit upholding Maryland’s denial of a water quality certification for AES Sparrows Point liquefied natural gas (LNG) import terminal in Baltimore County, a company spokesman said it was considering several option, including petitioning for rehearing by the full court.

Legality of 2007 Beaufort Sea Lease Sale Affirmed

A recent appeals court ruling means that Shell Alaska may continue to explore and develop its Beaufort Sea leases in Alaska. Recently a three-judge panel of the U.S. Court of Appeals for the 9th Circuit affirmed a lower court decision that the government’s Lease Sale 202 was conducted properly in 2007.

FERC Administrative Law Judge (ALJ) Bruce Birchman last Monday certified under seal a joint offer of settlement that, if ultimately approved by the agency, would resolve all charges that Energy Transfer Partners’ Oasis Pipeline LP and affiliates discriminated against nonaffiliated shippers and charged excessive rates in violation of Section 311 of the Natural Gas Policy Act (NGPA).
