The federal Internal Revenue Service earlier this month sued Public Service Company of New Mexico (PNM), alleging the utility received $4.2 million in 1998 and 1999 income tax refunds and claimed even more based on accounting methods that the IRS now contends were bogus. The allegations were made in a lawsuit filed in a federal district court, noting that PNM supposedly made the claims on the advice of its accounting firm, Deloitte & Touche LLP.

Enron Corp. fired back at California yesterday, filing a lawsuit against a state Senate committee to block a subpoena for internal documents covering virtually its “entire western marketing and trading operations.” The suit against the Senate Select Committee to Investigate Price Manipulation of the Wholesale Energy Market was filed in the Superior Court of the State of California in Sacramento.
IRS Okays Nymex For-Profit Plan
Nymex got final approval last week for its demutualization plan from the Internal Revenue Service, which said there would be no tax consequences for the organization or its members. The plan, which calls for the equity in the exchange to remain with the seat-owners of its Nymex Division, will make the exchange the first in New York to convert from a not-for-profit membership structure to a for-profit organization.
