Reliant Off the Hook in SEC Investigation

Federal investigators on Monday ordered Reliant Resources Inc. and CenterPoint Energy (formerly Reliant Energy Inc.) to cease violations of the anti-fraud and reporting/recordkeeping requirements of federal securities laws as part of a settlement entered into between the Securities and Exchange Commission and the companies. No penalties were involved.

FERC Works to Clarify November Power Refund Order

FERC last Wednesday sought to bring clarity to when power sellers would be on the hook for refunds under a sweeping order issued last year. That order, issued Nov. 20, proposed to revise all existing market-based rate tariffs and authorizations to prohibit the exercise of market power and anticompetitive behavior.

Reliant Energy’s Houston Lighting & Power (HL&P) couldbe on the hook for millions depending upon punitive damagesassessed in a case that has hit the utility with $4.2 million inactual damages awarded to three Texas cities. Lawyers for theplaintiffs last week suggested a punitive award in the range of $40million would be appropriate.
