FERC Grants NGPL’s Stiffer Credit Restrictions, Rejects Some Provisions

FERC denied requests for rehearing and stay by numerous pipeline customers and approved stiffer creditworthiness standards for Natural Gas Pipeline Company of America (NGPL), including a plan to suspend service within five business days if a shipper falls behind in payments a second time within six months and another plan that would halve the time period to 15 days for suspending service when a shipper is delinquent in payments.

A FERC judge late Wednesday scheduled a hearing for El Paso Corp. to challenge an agency subpoena that orders the energy company to furnish documents on its deceptive price reporting activities involving an energy publication.

FERC Grants Certificate for FGT Phase VI Expansion

The Federal Energy Regulatory Commission on Wednesday gave final approval to Florida Gas Transmission Co.’s (FGT) Phase VI expansion, which will add 85,356 Dth/d of capacity and 33 miles of pipeline to meet increasing demand mainly from gas-fired power generators in Mississippi, Louisiana, Alabama and Florida.

FERC Grants Certificates to Northwest, Kern River Laterals

FERC granted final certificates last Wednesday for Northwest Pipeline’s Grays Harbor lateral, which will serve a new Duke Energy power plant in Washington, and to Kern River Gas Transmission’s High Desert Lateral, which will deliver gas to the High Desert Power Project near Victorville, CA.

FERC granted a favorable preliminary determination on non-environmental grounds to the Georgia Strait Crossing project Wednesday. The 47.5-mile, 16-inch and 20-inch diameter pipeline would deliver 95,700 Dth/d of gas to Vancouver Island from connections with Northwest Pipeline and Westcoast Energy near Sumas, WA.

Judge Grants Dynegy’s Request to Move Enron Lawsuit to Texas

Barring an appeal, a federal judge on Wednesday granted Dynegy Inc.’s request to move its lawsuit against former merger partner Enron Corp. moved from New York City to a Texas court. U.S. District Judge Melinda Harmon of the Southern District of Texas ruled for Dynegy in its countersuit against Enron, which filed a $10.5 billion breach-of-contract lawsuit against its downtown Houston rival after Dynegy backed out of a merger plan at the end of November. Days later, Enron declared bankruptcy.

The Federal Energy Regulatory Commission (FERC) last week issued a favorable preliminary determination on non-environmental grounds to Tuscarora Gas Transmission’s Wadsworth Lateral, a 14.2-mile pipeline extension and associated facilities that would increase Tuscarora’s transportation capacity by 95,912 Dth/d. The lateral would extend from Tuscarora’s mainline in northern Washoe County, NV, to an interconnect with Pauite Pipeline in Nevada.

CPUC Grants More Time in Settlement Talks

California’s continuing uphill struggle for a market-basedsolution to its proposed restructuring of the wholesale natural gastransmission and storage business will be extended through Januaryin hopes that upwards of 75 market participants can attain anegotiated all-party settlement. A California Public UtilitiesCommission administrative law judge overseeing the statewide gascase and the CPUC President Richard Bilas indicated Wednesday (Oct.27) they were willing to allow more time.
