Aquila Launches Internal Probe, Dismisses Allegations of Accounting Improprieties

Aquila officials have dismissed allegations in an anonymous letter from a group of the company’s own employees that charges that company executives falsified earnings and manipulated corporate accounting in an effort to boost executive compensation. The letter has been forwarded to a special audit committee for an investigation, and the audit committee has notified the Securities and Exchange Commission of the matter.

The U.S. District Court for the Western District of North Carolina dismissed a consolidated class action lawsuit against Duke Energy that alleged breach of fiduciary duty related to the company’s retirement savings plan and the impact on Duke Energy common stock by the company’s disclosure of 89 round-trip gas and power trades.

The National Energy Board (NEB) has dismissed TransCanada PipeLines request for a review of the board’s June 2002 decision on the pipelines 2002 Fair Return Application (RH-4-2001). In its order, the NEB sharply lowered the pipeline company’s proposed toll increase and requested rate of return. Last week’s decision comes as the latest chapter in what has been a two-year dispute.

Judge Dismisses PUD Lawsuit Filed Against Power Suppliers

The Public Utility District No. 1 (PUD) of Snohomish County, WA, struck out a second time last Monday in its attempts to collect damages for high-priced power or renegotiate contracts signed during the western energy crisis. Monday’s loss came in the form of the dismissal of its case by a U.S. district judge in California. The judge ruled that the claims made by the PUD against power suppliers are preempted by FERC’s regulatory authority.

Southern Union Co. announced Monday that U.S. District Court Judge Roslyn O. Silver, in Phoenix has issued a Jan. 4, 2002 Order dismissing all of Southwest Gas’ and ONEOK’s claims against Southern Union, in the three-year battle over the merger that never happened.
