Oneok Fined for Contempt by OCC Judge

An administrative law judge at the Oklahoma Corporation Commission last week found Oneok and two of its subsidiaries, Oklahoma Energy Marketing and Trading and Oneok Gas Storage, in contempt for their refusal to provide documentation of their gas sales. The judge recommended to the commission that the companies be fined $2,000 per day retroactive to May 8 and lasting until they comply with the commission order.

Fluor Corporation and Duke Energy Corp. named Jeff Faulk president and CEO of Duke/Fluor Daniel, a joint venture of the two companies that provides global engineering, construction and operating services to fossil-fueled power generating facilities. Faulk comes to the partnership from Fluor Daniel, where he most recently served as senior vice president, operations for the Americas, within the energy & chemicals strategic business unit. Harvey Padewer, group president of Energy Services for Duke Energy, said the partnership is poised to emerge as the clear leader in fossil-fueled power generation under Faulk’s leadership. “Last year, Duke/Fluor Daniel was building one out of every 3 MW of natural gas-fired generation under construction in the U.S.,” Padewer said. “The industry is beginning to take serious notice of this partnership and its global project portfolio — that includes everything from combined cycle plants to innovative clean- burning coal technology.”

KCC Implements Disconnection Moratorium

The Kansas Corporation Commission (KCC) has extended its ColdWeather Rule emergency order and implemented a moratorium onservice disconnections for natural gas and electric service throughMay 31. The order provides emergency relief for customersstruggling to pay utility bills resulting from the record-breakingnatural gas prices this winter.

VA SCC Proposes Permanent Retail Access Rules

As it moves closer to statewide deregulation, the Virginia State Corporation Commission (SCC) is finalizing permanent rules that will govern retail access to competitive energy services for both the electric and natural gas industries. The SCC is calling for public comment on the proposed rules, which take effect Jan. 1, 2002.

FERC last week gave the green light to AES Corporation’sacquisition of IPALCO Enterprises, which owns Indianapolis Power& Light Co. The stock-for-stock transaction, which wasannounced last July, now only needs the approval of the Securitiesand Exchange Commission to be completed. AES is a global powercompany involved in generation, distribution and retail supplybusinesses. It sells electricity to more than 19 million end-usecustomers each year. Indianapolois, IN-based IPALCO Enterprises’sregulated subsidiary, Indianapolis Power & Light, serves about430,000 residential, commercial and industrial customers in centralIndiana.

Conditions Placed on NUI, VGC Merger

A Virginia State Corporation Commission hearing examiner hasrecommended that the planned merger between NUI Corp. and theVirginia Gas Co. include a condition that may affect the locationof an intrastate gas pipeline near Roanoke. The merger and proposedconditions require SCC approval and the commission must act byMarch 27.
