Federal review of all future energy mergers for compliance with antitrust laws will rest entirely with the Federal Trade Commission (FTC), according to a memorandum of agreement (MOA) worked out between the FTC and the Department of Justice’s antitrust division.

AGLC Files GPSC-Required Cost-of-Service Study
In compliance with a Georgia Public Service Commission (GPSC) order, Atlanta Gas Light Co., a wholly-owned subsidiary of AGL Resources Inc., filed its cost-of-service study as part of the ongoing review of the company’s earnings. The investigation stems from two separate but related studies, which the adversary staff of the GPSC said showed that AGLC’s earnings are 4-7% more than its authorized return on equity (ROE) (see Daily GPI, Aug. 23, 2001).

Columbia Gulf Holds Open Season for Possible Expansion
Columbia Gulf Transmission is holding an open season for a possible pipeline expansion in compliance with a 1997 FERC order (Docket No. CP93-736) approving a settlement agreement with shippers over issues dating back to Order 636. A Columbia spokesman noted that the Gulf rig count is still extremely high and there could be demand for an expansion of Columbia Gulf. However, Columbia is not holding this open season because shippers have been knocking on its doors begging for new capacity. This market test is being done for purely legal reasons, the spokesman said.
NJBPU Staff Urge GPU-FirstEnergy Merger Rejection
Staff at the New Jersey Board of Public Utilities (NJBPU) has urged state regulators to reject the pending merger between FirstEnergy Corp. and GPU Inc. on the grounds that the two companies have failed to back up claims that the merger will not harm ratepayers in the Garden State, among other things.
FERC: Independence’s Compliance Plan May Jeopardize Certificate
FERC staff warned Independence Pipeline Co. and ANR Pipeline last week that their certificate authority to build the much-maligned Independence project and associated SupplyLink expansion “could be in jeopardy” if they don’t submit by May 1, 2001 the initial plans for how they intend to comply with Commission-imposed environmental requirements.
