Arthur Brisbane, who acts as the “readers’ representative,” wrote an opinion piece in the Sunday Times following accusations by critics that the newspaper and reporter Ian Urbina had used “fear mongering” to criticize the industry, comparing it to a “Ponzi” scheme with a future like Enron Corp. or the dot-com bubble (see Shale Daily, June 28). Capping off a year-long probe into Arthur Andersen’s role in the collapse of Enron Corp., the House Energy and Commerce Committee last Tuesday referred criminal charges to the Justice Department against former Enron auditor’s in-house counsel, Nancy Temple, for allegedly providing false testimony last January to a congressional panel that was investigating the shredding of Enron documents.

U.S. District Judge Melinda Harmon handed Arthur Andersen LLP the maximum sentence in Houston on Wednesday — five years probation and a $500,000 fine — for obstructing justice in its handling of Enron Corp.-related documents that stymied a federal investigation of the company’s finances. Although it seemed minuscule when compared to the substantial market damage caused by the Enron scandal, the punishment was the harshest allowed under law. Andersen attorneys said they would appeal.
