Pennsylvania Court Splits Act 13 Injunctions

Nearly three weeks after ruling that portions of Act 13, Pennsylvania’s new omnibus Marcellus Shale law, were unconstitutional, the Commonwealth Court on Wednesday ordered that an injunction against the law’s preemption provision will remain in place pending appeal, while one affecting setback waivers is lifted.

A unit of S&T Bank has formed an alliance with Oklahoma-based Heritage Trust Co. to provide financial services for landowners who lease their property to natural gas drilling companies in the Marcellus Shale. S&T Wealth Management services will include lease and lease renewal offers and negotiation; negotiation of surface damage rights; and verification, monitoring and administration of royalty payments. Indiana, PA-based S&T Bank operates 51 offices in 10 counties in western and central Pennsylvania, including Allegheny, Butler and Westmoreland counties.

In its first crackdown on fraudulent investment activities involving natural gas drilling in the Marcellus Shale, the Pennsylvania Securities Commission (PSC) on Thursday ordered an Allegheny County firm and its owner to stop selling unregistered securities in the state.

Marcellus Shale activity has clearly taken hold in western Pennsylvania. In the region’s Allegheny County the number of properties leased for oil/gas exploration climbed by 322% between 2008 and 2009, and about 7% of the county’s land has been leased for drilling and extraction since 2003, according to University of Pittsburgh data.
