The U.S. Court of Appeals for the Fourth Circuit has dismissed multiple lawsuits challenging Mountain Valley Pipeline LLC (MVP) permits, conceding that Congress stripped the court of its jurisdiction as part of a deal to raise the debt ceiling earlier this summer.

However, Justices Roger L. Gregory, Stephanie D. Thacker and James Andrew Wynn raised concerns over the implications of Section 324 of the Fiscal Responsibility Act (FRA), which approves MVP’s permits and restricts jurisdiction over legal challenges to the project. The judges argued that Congress, by fast-tracking the completion of the heavily litigated MVP, risked violating the separation of powers.
