The U.S. Environmental Protection Agency’s (EPA) Environmental Appeals Board (EAB) has remanded permit applications for two wastewater disposal wells in Pennsylvania back to the agency’s Region 3 office in Philadelphia, on suspicion that inadequate testing of nearby drinking water wells was performed.

Oregon LNG Site Local Land-Use OK Again Questioned

For the second time in two years a state appeals board in Oregon on April 12 remanded to the local county authorities part of a land-use approval for the proposed NorthernStar Natural Gas Corp.’s Bradwood Landing LNG receiving terminal along the Columbia River about 25 miles upstream from the Pacific Ocean. Again, the Clatsop County Board of Commissioners is being asked to reexamine part of earlier approvals of the proposed $650 million LNG project.

Court Issues Stunner, Vacates 2007-2012 Offshore Leasing Plan

In a stunning decision Friday, an appeals court in Washington, DC, vacated and remanded to the Department of Interior the five-year leasing plan for 2007-2012 for reconsideration, a decision that threatens to upset the current leasing schedule and raises questions about sales that already have been completed under the plan. The decision cited the agency’s failure to “properly consider” the environmental sensitivity and marine productivity of the different areas of the Outer Continental Shelf (OCS) that are included in the leasing plan.

Court Petitioned to Clarify Ruling on OCS Leasing Plan

The Department of Justice (DOJ) filed a petition Tuesday seeking clarification of a recent appellate court decision that vacated and remanded the existing five-year Outer Continental Shelf (OCS) leasing plan for 2007-2012 (see Daily GPI, April 20). The decision has the potential to upset the current leasing schedule and raises questions about oil and gas leases that have already been completed under the plan.
