CPOs Back CFTC Jurisdiction over Commodity Mutual Funds

Reinstating requirements applicable to commodity pool operators (CPO) to apply to certain mutual fund operators, which were excluded in amendments passed in 2003, would level the playing field for investors with respect to pooled vehicles that utilize the same instruments to meet their investment objectives, CPO Steben & Co. of Rockville, MD said in comments filed at the Commodity Futures Trading Commission (CFTC) last Monday.

Transportation Notes

Only a day after ending a three-day systemwide Stage 2 high-inventory OFO Tuesday, Pacific Gas & Electric is reinstating it Wednesday on its California Gas Transmission system. As on Sunday and Monday of the previous OFO, the new one will have $1/Dth penalties for exceeding a 5% tolerance for positive daily imbalances.

Pacific Gas & Electric allowed Saturday’s high-inventory OFO to lapse Sunday before reinstating it for Monday’s gas day. The OFO was to be lifted again Tuesday.
