A federal appeals court has rejected a challenge to the FERC certificate authorizing Transcontinental Gas Pipe Line Co. LLC’s (Transco) Garden State Expansion project, but it remanded part of the case to New Jersey regulators in a sharp display of how the courts are weighing federal and state responsibilities in permitting infrastructure projects as opposition increases.

PennEast Pipeline Co. LLC said New Jersey regulators’ rejection of a permit application for the project was not a surprise, and the company plans to resubmit it.

The New Jersey Department of Environmental Protection (NJDEP) notified PennEast Pipeline Co. LLC Wednesday that its application for a state freshwater wetlands permit is incomplete, due in part to a lack of landowner permission to survey certain parts of the proposed route.
