Court: FERC’s Decision to Include LDCs in Pipe Rates Slants Outcome
The U.S. Court of Appeals for the District of Columbia Circuit last week remanded the natural gas pipeline rates for Petal Gas Storage and High Island Offshore System (HIOS) after concluding that FERC had mistakenly based the rates on a proxy group to include local distribution companies (LDC). The three-judge panel ruled that the Commission’s decision to include the LDCs, which carry less risk than interstate pipes, compromised the outcome of the rate cases.

Transportation Notes
Effective Thursday, Tennessee will begin accepting nominations for up to 40 MMcf/d of receipts into its system from High Island Offshore System (HIOS) at West Cameron 167. Within a few days Tennessee expects to be able to gradually increase the volumes it receives from HIOS as the accumulated condensates in the pipelines are removed from the system. Parties delivering gas into Tennessee at West Cameron 167 must arrange for gas processing services at the new Grand Chenier gas plant, Tennessee said.
Transportation Notes
Transco said unfavorable weather had delayed the progress of repairs to a section of pipe in Eugene Island Block 135 on its Southeast Louisiana Lateral that was damaged during Hurricanes Katrina and Rita. Transco now anticipates completion of the work on Feb. 15; it had previously expected to finish Jan. 31 (see Daily GPI, Jan. 16).
Former AEP Desk Chief to Pay $350,000 for Bogus Gas Trades
The former chief of the American Electric Power’s (AEP) Gulf trading desk agreed to pay a $350,000 fine to the Commodity Futures Trading Commission (CFTC) to settle charges that he directed AEP natural gas traders to submit misleading or knowingly inaccurate information to two Platts’ publications, Gas Daily and Inside FERC’s Gas Market Report for almost two years (see Daily GPI, Sept. 21, 2005).
