Northern Allowed to Hold Third-Party Capacity

FERC last week changed its tune and cleared the way for NorthernNatural Gas to acquire off-system, interruptible capacity fromthird-party pipelines. On rehearing of a July order, the Commissionfound that since Northern Natural sought the IT capacity to augmentits own operations, rather than for the purpose of re-marketing it,its request did not raise the concerns cited in a 1997 TexasEastern Transmission (Tetco) case.

FERC last week changed its tune and cleared the way for NorthernNatural Gas to acquire off-system, interruptible capacity fromthird-party pipelines. On rehearing of a July order, the Commissionfound that since Northern Natural sought the IT capacity to augmentits own operations, rather than for the purpose of re-marketing it,its request did not raise the concerns cited in a 1997 TexasEastern Transmission case. There, FERC feared that third-partypurchases could lead to preferential treatment for purchasingpipelines and could limit the capacity choices of other customerson third-party systems.

FERC Approves Williams’ Park & Loan Service

The Federal Energy Regulatory Commission has conditionallyapproved a new interruptible park and loan service (PLS) to starttoday on Williams Gas Pipelines Central. The service – allowingcustomers to park or request a loan of gas at each of Williams’pools – was designed to give those customers greater flexibility ina market that has evolved from a monthly to a daily business. FERCapproved the service subject to refund and certain conditions.

Halt of IT Discounting Not Tied to NGC Contracts

El Paso Natural Gas conceded Wednesday it discontinueddiscounting interruptible transportation early this year, but saidits action was primarily due to its new status as “swing supplier”of California-bound transportation – a position that it says givesit free reign to charge maximum IT rates.
