FERC last Wednesday held off on releasing a much-anticipated final transmission pricing policy statement in order to further explore and flesh out issues related to passive ownership and independence.

FERC this week will put some meat on the bones of an electric order it issued late last year proposing to revise all existing market-based rate tariffs and authorizations in order to prohibit anti-competitive behavior or the exercise of market power, FERC Chairman Pat Wood told reporters last Wednesday after appearing at a breakfast meeting sponsored by the Electric Power Supply Association (EPSA). The order has come under criticism from some quarters as being ambiguous and placing an open-ended refund condition on sellers of power.

Seeking to flesh out several key points of a sweeping market monitoring and mitigation plan for California’s ailing energy markets, FERC recently said that it expects California’s Independent System Operator (Cal-ISO) to ensure the presence of a creditworthy buyer for all transactions made with any generator that offers power in compliance with a must-offer requirement included in the monitoring and mitigation plan.

Chairman James Hoecker last week announced that FERC plans tohold a workshop with the gas industry in mid-October to flesh outthe details involved in the auctioning of short-term capacity. Theworkshop will occur prior to the deadline for industry comments onthe notice of proposed rulemaking (NOPR) that addresses regulationof short-term capacity, specifically the auctioning of thatcapacity. The comments are due in early November.
