Pennsylvania Supreme Court Considers Act 13 Appeal

The Pennsylvania Supreme Court last week was asked to decide whether to uphold or overturn a lower court ruling in July, which declared that portions of the Act 13, which imposes an impact fee on producers, were unconstitutional see NGI, July 30). Plaintiffs argue that the law limits local zoning rules and violates municipalities’ right to substantive due process ((Robinson Township et al. v. Commonwealth et al., No. 284-MD-2012).

Kinder Morgan Inc. Wednesday morning declared a force majeure on a portion of its Natural Gas Pipeline Company of America (NGPL) natural gas pipeline in North Texas while media reports said “a massive orange haze” from a fire filled the area sky in the Texas Panhandle.

Ruby Pipeline flows have been cut to zero until further notice as Ruby declared a force majeure after experiencing a fire and some damage Saturday in its block valve 6 yard in a remote area of southeastern Cache County, UT. A segment of its pipeline around the block valve 6 was shut in and isolated to allow damage assessment and repairs. Ruby said Sunday it is unable to receive or deliver gas. Based on an inspection of the fire damage, which occurred at a gas line to auxiliary equipment, the damage will require more repairs to the valve, valve operator and auxiliary equipment than initially thought, the pipeline added. A road to the snow-covered site has been plowed and repair crews are on site.

El Paso Corp.’s Tennessee Gas Pipeline Co. LLC (TGP) declared a force majeure following a rupture of a line near Batesville, MS, on Nov. 21. “About 8:30 [p.m.] one of the station operators at our Station 63 noticed a pressure change in the line…We immediately activated our emergency response plan, isolated the lines and began our regulatory notifications,” El Paso spokeswoman Gretchen Krueger told NGI. About 20 homes were evacuated; there were no injuries. The line was shut in, and an investigation was ongoing. The force majeure affects the line from MLV (Main Line Valve) 63-1 to MLV 64-1, Tennessee said in a customer notice.
