In response to collapses at Peregrine Financial Group Inc. (see NGI, July 23) and MF Global Holdings Ltd. (see NGI, Nov. 14, 2011), both of which involved the misappropriation of customer funds, the Commodity Futures Trading Commission (CFTC) last week voted out a proposed set of rules to provide a greater level of protection to customers that participate in the futures and swaps markets, including the protection of customer funds held by futures commission merchants (FCM) and derivatives clearing organizations.

The Commodity Futures Trading Commission (CFTC) Tuesday approved a final rule that amends certain existing regulations to implement aspects of the Dodd-Frank Wall Street Reform Act. Specifically, the CFTC amended certain definitions and recordkeeping regulations so that they apply to both futures and over-the-counter swaps. As an example, futures commission merchants and introducing brokers now will be required to follow recordkeeping rules for swap transactions that are the same that they presently follow for futures transactions. The final rule is to become effective 60 days after publication in the Federal Register.

The Commodity Futures Trading Commission (CFTC) has begun responding to market participant’s questions about the regulations stemming from the Dodd-Frank Wall Street Reform Act, namely the start date for swap data reporting and the reporting of cleared swap transactions. Compliance with the final rule is required once the agency has responded to a question or clarified a Dodd-Frank issue, said Commissioner Bart Chilton (see Daily GPI, Oct. 10). But in the event the CFTC doesn’t answer questions by Friday, Chilton said, “it would not be appropriate, reasonable or responsible for the Commission to proceed against entities for non-compliance with a Dodd-Frank rule unless and until they have received a response from the agency to an existing request.”
