FERC Staff: El Paso Had Market Power, Committed Affiliate Abuse

Two El Paso Corp. subsidiaries, El Paso Natural Gas and El Paso Merchant Energy Co. (EPME), possessed market power — the ability to maintain prices above competitive levels — during the summer of 2000, and violated FERC’s marketing affiliate standards that govern the behavior of interstate pipelines and their affiliates, FERC staff counsel has concluded.

Transco notified shippers Monday that the North Terrebonne GasProcessing Plant in South Louisiana resumed processing committedplant owner and third-party gas production as of Thursday. Theplant had suspended operations Jan. 1, a Transco spokesman said.

Public Power Utilities Join B2B Exchange Network

Public power utilities are jumping into the B2B act too — morethan 225 community-owned electric utilities have committed up to$1.2 billion in purchasing power to UtilityFrontier.com, a nationalexchange launched earlier this year. The utilities will use the B2Bas a purchasing exchange to serve more than 6.7 million electricmeters — about one third of all public power customers.

CMS Energy Corp.’s Trunkline LNG Co. subsidiary announcedyesterday it has 41 committed cargoes to be delivered this year toits Lake Charles, LA, LNG terminal. The cargoes total nearly 110Bcf of LNG.

Kinder Morgan Faces Class Action Lawsuit

A class action lawsuit alleging that KN Energy Inc., now KinderMorgan Inc., violated federal securities laws, committed fraud andmisrepresented itself has been filed in U.S. District Court for theDistrict of Colorado by a Denver law firm. Dyer & Shuman LLPsaid it had filed the lawsuit on March 8 on “behalf of persons whopurchased or otherwise acquired the shares of KN EnergyInc…between March 19, 1997 and March 9, 1999.”
