San Diego Assails FERC Refund Calculations

FERC’s order requiring potential refunds of up to $69 million onJanuary bulk power sales in California has come under furtherassault, with San Diego County claiming that the “proxy marketclearing price” established by the Commission in the order allowssellers to recover almost double their marginal production costs,and that the decision not to subject sales during non-Stage 3emergencies to refunds was grossly unfair. It further blasted FERCfor not ordering power suppliers to publicly disclose their ratesand costs.

Initial Legislation in CA Gets Low Marks

California Gov. Gray Davis on Friday signed a short-term measure(AB 7X) to allow the state to get into the bulk power spotpurchasing business immediately. He also ordered the state waterresources department to begin setting up a power auction processanticipating it will be authorized by another new state law thatwill be finalized this week to seek long-term electricitycontracts. Observers and market participants, however, say themeasures probably are inadequate to solve the state’s currentsupply crisis.

Uniform Price Caps Sought in CA, Northwest Power Markets

Puget Sound Energy Inc. has called on FERC to levy price caps inthe Pacific Northwest bulk electricity markets that are equal towhat it ultimately decides to establish for the Californiawholesale market. Last week, the Commission proposed a “soft”$150/MWh price cap on wholesale sales of electricity in California.

It also madea few nips and tucks in the OCS order, especially with respect thefiling date for the reports and and the types of shippers that areexempted.
