FERC Administrative Law Judge Curtis L. Wagner asked parties involved in a settlement conference, which resulting from this week’s FERC order extending its power market mitigation program, to provide information to his office on a number of subjects, including a list of forward contracts, as early as today. With that tight deadline no doubt in mind, Wagner yesterday asked all sellers to provide the amount owed to them by the California Independent System Operator (Cal-ISO), California’s Power Exchange and Department of Water Resources by month (broken down by product) and how much they have been paid since last October.

Also, all sellers and the state of California are requested to provide Wagner a list of their forward contracts showing the terms and the price. In addition, the order states that sellers should be prepared to discuss how much generation they still have available for sale, both short term and long term. This information will not be shared unless permission is granted by the party furnishing it.

Wagner also asked all parties to provide him with a list of issues they feel should be discussed and settled during the conference. The order asked that the requested information be provided by today and said that the data could be provided via e-mail at curtis.wagner@ferc.fed.us .
